1. Acceptance of Terms
By accessing or using iCaria Care at Home ("iCaria", "we", "us"), including our website, mobile application, and related services, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. About iCaria
iCaria is a care coordination platform that connects loved ones and their families with qualified care providers. We facilitate the connection between care seekers and independent care professionals. iCaria does not directly provide medical or healthcare services.
3. Eligibility
You must be at least 18 years old to create an account or use our services. By using iCaria, you represent that you meet this age requirement and have the legal capacity to enter into these terms.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration. Notify us immediately of any unauthorized use of your account.
5. Use of Services
You agree to use iCaria only for lawful purposes and in accordance with these terms. You may not: (a) use the platform to harass, abuse, or harm others; (b) impersonate any person or entity; (c) interfere with or disrupt the platform's operation; (d) attempt to gain unauthorized access to any part of the service; or (e) use the service for any commercial purpose not expressly permitted.
6. Care Providers
Care providers on the iCaria platform are independent professionals, not employees of iCaria. While we verify credentials and conduct background checks, we do not guarantee the quality, safety, or suitability of any provider. You acknowledge that iCaria serves as a coordination platform and assumes no liability for the actions or omissions of care providers.
7. Payments, Fees, Taxes, and Cancellations
Certain services on iCaria require payment. Prices are shown exclusive of tax; applicable sales taxes (such as GST/HST in Canada) are calculated at the time of billing and appear as separate lines on your invoice. Fees are non-refundable unless otherwise stated. We reserve the right to modify pricing with reasonable notice. Payment processing is handled by secure third-party providers. If you cancel a confirmed booking after the notice period for that service has passed, or if no one is available when your care professional arrives, a late-cancellation charge applies. This charge is the price of what iCaria has already delivered for that booking — matching and scheduling a care professional, reserving the time exclusively for you, and dispatching them — together with the compensation owed to the care professional for time they held and can no longer fill. It is a charge for services performed, not a penalty. Applicable taxes are added to iCaria's portion of the charge. The notice period and the charge that apply to a booking are those in effect when that booking is confirmed. Current amounts are shown in your account and are available from support at any time. We may reduce or waive a late-cancellation charge at our discretion — for example, where the cancellation follows an illness or an emergency.
8. Intellectual Property
All content, design, logos, and software on the iCaria platform are owned by or licensed to iCaria and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of our platform without our express written permission.
9. Limitation of Liability
To the fullest extent permitted by law, iCaria and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount you paid to iCaria in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless iCaria, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the platform or violation of these terms.
11. Termination
We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the platform ceases immediately. Provisions that by their nature should survive termination will remain in effect.
12. Communications
By creating an account, you consent to receive transactional communications from iCaria related to your use of the service (e.g., appointment confirmations, care updates). You may opt out of promotional communications at any time.
13. Changes to These Terms
We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on our platform. Your continued use of iCaria after such changes constitutes acceptance of the revised terms.
14. Governing Law
These terms are governed by and construed in accordance with the laws of Canada. Any disputes arising from these terms shall be resolved in the courts of the applicable jurisdiction.
